3D FILES - PERSONAL USE

At FluxJet Kayaks LLC (“FluxJet”), we love seeing our customers personalize and maintain their kayaks. From time to time, we may provide access to certain 3D CAD files (including STEP, STL, or similar formats) (“3D Files”) to help you 3D print specific parts for your own kayak.

These 3D Files remain the intellectual property of FluxJet Kayaks LLC. However, we grant you — as a verified FluxJet customer — a limited, non-exclusive, non-transferable license to use the 3D Files for personal, non-commercial use only in connection with your personally owned FluxJet Kayak.

This means you are welcome to:

  • 3D print parts for your own use;
  • Modify files as needed to suit your personal kayak setup;
  • Reprint replacement components for yourself.

To protect the integrity of our designs and the broader FluxJet community, you may not:

  • Send the 3D Files to any third parties for any reason (they are free to download, but we want these terms and conditions accepted by anyone who does)
  • Sell, distribute, or commercially manufacture parts from the 3D Files;
  • Share or upload the 3D Files to public file-sharing platforms;
  • Provide the 3D Files to third parties for commercial purposes;
  • Use the 3D Files to produce parts for competing products.

If you are interested in commercial production, dealer support, or broader distribution, please contact us — we are always open to collaboration.

FluxJet reserves the right to discontinue or revoke access to 3D Files if these terms are not respected.

ORDER CANCELLATIONS

A customer can cancel their order under these conditions:

  • Prior to the FluxJet Kayak Shipping: 2.5% transaction fee. This covers the credit card processor fee that is passed onto FluxJet Kayaks and FluxJet Kayaks cannot recover.
  • After receipt of the FluxJet Kayak but still in the unwrapped polybag-packaging and within 30 days of receipt: 2.5% transaction fee, 10% restocking fee plus outbound shipping charge and return shipping charges.

FAILURE TO RESPOND / INABILITY TO CONTACT / NON-PAYMENT

When we notify you that your order is ready for final assembly, configuration, shipment, or final balance payment, you agree to respond promptly and complete any required actions (including payment of any outstanding balance).

If:

  • we are unable to contact you using the email or phone contact details you provided at the time of purchase
  • we are unable to contact you using the email or phone contact details you updated, and received acknowledgement from us that the records were properly updated, since the time of purchase;
  • we do not receive a response from you within four (4) weeks of our first attempted contact; or
  • any requested final balance payment is not received within four (4) weeks of our payment request,

we reserve the right, at our sole discretion, to cancel your order.

In the event of cancellation under this clause, we will refund amounts paid by you, less:

  • any non-refundable transaction or payment processing fees; and
  • any other direct third-party charges incurred by us in connection with your order.

You are responsible for ensuring your contact details remain accurate and up to date, and for making payment when due.

REFUNDS/RETURNS

There are no refunds or returns after receipt of the FluxJet Kayak and it has been taken out of the packaging.

LIMITED WARRANTY

FluxJet Kayaks, LLC hereby warrants that new FluxJet Kayaks purchased from www.fluxjetkayaks.com and from an authorized FluxJet Kayaks dealer located within the continental USA will be free from defects in workmanship and materials, under normal personal recreational use and conditions, for a period of two (2) years from the original purchase date, subject to exclusions provided below. 

FluxJet Kayak warranty is registered with the buyer and is not transferrable. The warranty is void if any unauthorized party opens any sealed compartment without FluxJet Kayaks’ express written consent.

EXCLUSIONS

Excluded from warranty coverage are the following:

  • FluxJet Kayaks purchased, used and/or converted for commercial or rental purposes;
  • Damage resulting from misuse, abuse, negligence, accidents or collisions;
  • Damage due to improper or inadequate storage, transportation and/or maintenance;
  • Use of unauthorized parts and/or accessories in the operation of a FluxJet Kayak;
  • Use of the Kayak outside of listed weight parameters: maximum 400 pounds (including payload/gear);
  • Use of the Kayak beyond its intended use, including, but not limited to, operation in heavy surf, waves;
  • Kayaks sold outside of the USA and imported for use herein;
  • Kayaks sold inside the Continental USA and exported for use outside thereof;
  • Excessive use; beyond reasonable and fair wear and tear:
  • Failure to operate your FluxJet Kayak in accordance with the rules and regulations required for safe operation, including, but not limited to, use of a FluxJet Kayak without a life vest and/or use of a FluxJet Kayak while impaired by alcohol and/or drugs;
  • Parts replacement for normal wear and tear.

ARBITRATION AGREEMENT

Any dispute, claim, or controversy arising out of or relating to this Agreement or the sale, shipment, or use of the product shall be resolved exclusively by final and binding arbitration administered by JAMS under its applicable rules. The arbitration shall take place in Collin County, Texas, unless otherwise agreed in writing. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. The losing party shall bear all arbitration costs incurred by both parties. No attorneys’ fees can be charged or awarded. By purchasing this product, the buyer acknowledges and agrees to resolve all disputes through arbitration and waives any right to trial by jury or participation in a class action.

WARRANTY CLAIMS

Claims for defects in workmanship and/or materials must be made within thirty (30) days of discovery by contacting FluxJet Kayaks via email at info@fluxjetkayaks.com or via 844-FLUXJET (358-9538)

FluxJet Kayaks, LLC, shall, upon notice of a valid, non-void warranty claim, supply replacement parts to the consumer, along with instructions for repair. Should the consumer elect not to perform required warranty repairs, consumer can return the Kayak to FluxJet Kayaks for repair; however, shipping and handling costs are not included under this warranty. Returns of Kayaks to FluxJet Kayaks for repair are subject to handling costs of Fifty and no/100 Dollars ($50.00) each way.

SHIPPING/EXPORT

FluxJet Kayaks will ship to the purchasers address as listed during checkout. FluxJet Kayaks will only send internationally to authorized FluxJet Kayak distributors to ensure that you have local support for warranty and service. FluxJet Kayaks will not assist in or provide any documentation to FluxJet customers or to 3rd party freight/logistics companies in any effort to export our products outside of the United States, unless legally required to do so.

THIS WARRANTY PROVIDES YOU WITH SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

FLUXJET KAYAKS, LLC MAKES NO EXPRESS WARRANTY OR CONDITION WHETHER WRITTEN OR ORAL AND THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS NOT STATED IN THIS LIMITED WARRANTY. ANY IMPLIED WARRANTY OF CONDITION OF MERCHANTABILITY, SATISFACTORY QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED TO THE DURATION OF THE EXPRESS WARRANTY SET FORTH ABOVE. SOME STATES DO NOT ALLOW A LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OF LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS. IN SUCH STATES, SOME EXCLUSIONS OR LIMITATIONS OF THIS LIMITED WARRANTY MAY NOT APPLY TO YOU. FOR CONSUMER TRANSACTIONS, THE LIMITED WARRANTY TERMS CONTAINED IN THIS STATEMENT, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODITY BUT ARE IN ADDITION TO THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF FLUXJET KAYAKS TO THE CONSUMER.
